Kimberly-Clark makes wipes under the Kleenex brand that trick customers into thinking they're buying a product that kills germs, when the product is "actually just a wet wipe with water that they paid a premium for," it alleges. a new class action lawsuit.Plaintiffs Judah Rosenwald, Craig Chouraki-Lewin, Cindy Rutter, William Rutter, Trinity Guevremont, Natasha Garamani, James Smith, Patricia Perez, Jeanine Eckert, and Preston Leschins filed the class action lawsuit against Kimberly Clark Corporation on August 31 in federal court in California, alleging violations of state and federal consumer laws.The lawsuit is based on the marketing of Kimberly-Clark's product "Kleenex wet wipes germ removal."The product was sold throughout the United States, at pharmacies such as Walgreens and other large retailers, the lawsuit claims.According to the plaintiffs, Kimberly-Clark misrepresents the "germ-killing" feature of baby wipes in a label that says "removes 99% of germs from the skin."In fact, there are no germicidal ingredients in the product, the plaintiffs say."The only operative ingredients in the product are mild surfactants, that is, soaps or cleansers, specifically 'coco-betaine' and 'polysorbate 20,'" the suit alleges.A reasonable consumer would not distinguish between "killing" and "eliminating" germs, the lawsuit claims, and Kimberly-Clark uses it to their advantage."Kimberly-Clark relies on consumers' familiarity with 99%, 99.9% or 99.99% representations of germicidal products to sell what is really just soap, and at a premium over products that simply contain surfactants, or soaps, including other Kimberly-Clark wet wipes products," he says.Each of the plaintiffs bought the product believing it had capabilities that the product does not, they say."Consumers think they're buying a product that kills germs like an alcohol-based germicide, but it's really just a water-moistened wipe for which they've paid a premium."The plaintiffs purport to represent all U.S. consumers who have purchased the "germ-killing" product Kleenex, from any time to the present, as well as a group of consumers from California, Washington, Wyoming, Colorado, Pennsylvania, New York, New Jersey and Florida.The plaintiffs rely on state consumer laws and seek class action certification, damages, fees, costs, and a jury trial.Meanwhile, Kimberly-Clark has agreed to pay a $20 million settlement to end claims that its wet wipes damage and clog pipes, and the settlement could benefit consumers across the country.What do you think of the class action lawsuits against Kimberly-Clark?Give us your opinion in the comments.The plaintiffs are represented by David M.
